Royal Decree 80/2023 regarding Tax Exemption

Arabic

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Financial Law promulgated by Royal Decree 47/98,

the Income Tax Law promulgated by Royal Decree 28/2009,

the Excise Tax Law promulgated by Royal Decree 23/2019,

the Value Added Tax Law promulgated by Royal Decree 121/2020,

and the System of the Tax Authority and the Adoption of its Organisational Structure promulgated by Royal Decree 42/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The Minister of Finance shall assume the competence of tax exemption wherever it is provided in laws and royal decrees.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 79/2023 Ratifying the Agreement between the Government of the Sultanate of Oman and the Government of the Slovakia Republic on the Mutual Visa Exemption for Holders of Diplomatic, Special, and Service Passports

after perusal of the Basic Statute of the State,

and the Agreement between the Government of the Sultanate of Oman and the Government of the Slovak Republic on the Mutual Visa Exemption for Holders of Diplomatic, Special, and Service Passports signed in the city of New York on 21 September 2023,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 78/2023 regarding the Taking of the Oath

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, the Law Regulating the Accounting and Auditing Profession promulgated by Royal Decree 77/86, the Police Law promulgated by Royal Decree 35/90, the Advocacy Law promulgated by Royal Decree 108/96, the Judicial Authority Law promulgated by Royal Decree 90/99, the Public Prosecution Law promulgated by Royal Decree 92/99, the Law of Public Notaries promulgated by Royal Decree 40/2003, the Civil Service Law promulgated by Royal Decree 120/2004, the Law Governing the Foreign Ministry promulgated by Royal Decree 32/2008, the State Financial and Administrative Audit Law promulgated by Royal Decree 111/2011, the Statistics and Information Law promulgated by Royal Decree 55/2019, the Internal Security Service Law promulgated by Royal Decree 4/2020, the Municipal Councils Law promulgated by Royal Decree 126/2020, the Law of Majlis Oman promulgated by Royal Decree 7/2021, the Military Justice Law promulgated by Royal Decree 110/2011, the Labour Law promulgated by Royal Decree 53/2023, and in pursuance of public interest,

have decreed as follows

Article I

With the exception of the oath taken before the Sultan and the oath taken by members of the Majlis Al-Dawla, members of Majlis Al-Shura, and judges, the oath stipulated in the laws shall be taken by signing a written oath in accordance with the following form: “I swear by Allah the Almighty to respect the Basic Statute of the State and the laws and legislation in force, to perform my work with honestly, honour, and trustworthiness, and to preserve public property, the dignity of the office, and its secrets.” All employees of units of the administrative apparatus of the state and other public legal persons shall, before commencing their work, sign the oath undertaking stipulated in the first paragraph of this article.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Civil Service Law promulgated by Royal Decree 120/2004,

and the System of Governorates promulgated by Royal Decree 36/2022,

and in pursuance of public interest,

have decreed as follows

Article I

Those named below are hereby appointed governors in the governorates assigned to each of them:

– Engineer Masoud bin Saeed bin Hashim Al-Hashimi, Governor of Batinah South with the special grade.

– Mahmoud bin Yahya bin Suleiman Al-Dhuhli, Governor of Sharqiyah North with the special grade.

Royal Decree 73/2023 Assigning the Competences Relating to the Review of Contracts to the Secretariat General of the Tender Board by Way of Transfer from the Ministry of Justice and Legal Affairs

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 84/2020 regarding the Secretariat General of the Tender Board,

and Royal Decree 88/2020 Merging the Ministry of Justice and the Ministry of Legal Affairs into One Ministry Named the Ministry of Justice and Legal Affairs, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

The competences relating to the review of contracts are hereby assigned to the Secretariat General of the Tender Board by way of transfer from the Ministry of Justice and Legal Affairs, which are as follows:

1. Reviewing draft standard model contracts prepared by units of the administrative apparatus of the state and other public legal persons in the cases stipulated by law.

2. Reviewing draft contracts whose value exceeds 5,000,000 (five million) Rial Omani, and variation orders relating to them regardless of their value, before signing them and executing them by any unit of the administrative apparatus of the state and other public legal persons. Reviewing contracts other than standard model contracts includes the procedures prior to contracting.

Article II

The technical members and legal advisors of the Ministry of Justice and Legal Affairs concerned with the review of contracts, and other employees of the ministry whose work relates to such review, are hereby transferred to the Secretariat General of the Tender Board with their same seniorities and financial grades. The stipends they receive that relate to the nature of their current positions remain with them in a personal capacity.

The transfer of those mentioned must be in accordance with the mechanism agreed upon between the Minister of Justice and Legal Affairs and the Secretary General of the Tender Board.

Article III

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 72/2023 Amending Some Provisions of the System of the Police College

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and Royal Decree 62/2000 Amending the Name of the Police Academy and Promulgating the System of the Police College,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned System of the Police College shall be implemented.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 71/2023 Promulgating the Law on the Expropriation for Public Benefit

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The attached law shall apply in regard to the expropriation for public benefit.

Article II

The Minister of Housing and Urban Planning shall issue the executive regulation of the attached law after the approval of the Council of Ministers, and shall also issue the necessary decisions for implementing its provisions, and until they are issued, the existing regulations and decisions continue to operate to the degree that they do not contradict with its provisions.

Article III

The aforementioned Law on the Expropriation for Public Benefit is hereby repealed, as well as all that is contrary to the attached law, or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 70/2023 Transferring and Appointing in the Diplomatic Corps

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, and the Law Governing the Foreign Ministry promulgated by Royal Decree 32/2008, and in pursuance of public interest,

have decreed as follows

Article I

The ambassadors named below are hereby transferred to the headquarters of the Foreign Ministry:

1. Dr Said bin Mohammed bin Ali Al-Barami, Our ambassador to the Kingdom of Morocco.

2. Najeeb bin Yahya bin Zerouk Al-Balushi, Our Ambassador to the State of Qatar.

Article II

The following are hereby granted:

1. Minister Plenipotentiary Khalid bin Salim bin Ahmed Bamukhalif the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Kingdom of Morocco.

2. Counsellor Ahmed bin Mohammed bin Nasser Al-Araimi the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the French Republic.

3. Counsellor Sayyida Wafa bint Jabr bin Nasser Al-Busaidiya the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Republic of Uzbekistan.

4. Counsellor Malallah bin Mahmoud bin Shaaban Al-Balushi the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to Hungary.

5. Counsellor Sheikh Fahad bin Abdulrahman bin Ahmed Al-Ojaili the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Hashemite Kingdom of Jordan.

6. Counsellor Fahad bin Suleiman bin Khalaf Al-Kharusi the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Islamic Republic of Pakistan.

7. Counsellor Nasra bint Salim bin Mohammed Al-Hashimiya the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Republic of Kenya.
