Royal Decree 40/2001 Transferring the Deputy President of the Commercial Court

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the Civil Service Law issued by Royal Decree 8/80 and its executive regulation and their amendments,

Royal Decree 79/81 Establishing the Commercial Court and its amendments,

and Royal Decree 64/91 Appointing a Deputy President of the Commercial Court,

and in pursuance of public interest,

have decreed as follows

Article I

Othman bin Abdullah bin Hamad Al-Yahyai is hereby transferred from the Commercial Court to the Ministry of Justice.

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

and Royal Decree 90/85 Determining the Employment Status of the Position of “Secretary General”,

and in pursuance of public interest,

have decreed as follows

Article I

Dawood bin Nathar bin Sumar Al-Zadjali, Secretary General of the National Organization for Scouts and Guides, is hereby promoted from the first grade in the first cycle to the grade designated to an undersecretary of a ministry with the same current position.

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

The mentioned Convention 182 and Recommendation 190 are hereby ratified.

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

Royal Decree 37/2001 on the Accession of the Sultanate of Oman to the Patent Cooperation Treaty

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Patent Cooperation Treaty within the framework of the World Intellectual Property Organization,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the mentioned Patent Cooperation Treaty is hereby approved.

Article II

Competent entities shall deposit the instrument of accession to the mentioned treaty in accordance with its provisions.

Article III

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

Royal Decree 35/2001 Amending the Law Regulating the Accounting and Audit Profession

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law Regulating the Accounting and Auditing Profession issued by Royal Decree 77/86 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The texts of articles 29 and 31 of the mentioned Law Regulating the Accounting and Auditing Profession are hereby replaced with the following texts:

29. The licence to practise the profession is valid for a period of five years from the date of registration in the register, provided that the registration is renewed every five years from the date of registration or the previous renewal. The renewal application must be submitted on the form prepared by the Ministry of Commerce and Industry for this purpose at least two months before its expiry.

31. The fees for registration and renewal in the register and the fees for retrieving the information recorded in it must be determined by a decision by the Minister of Commerce and Industry after the approval of the Ministry of Finance.

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its publication.

Royal Decree 32/2001 Adopting the Organisational Structure of the Ministry of Education

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

Article I

The organisational structure of the Ministry of Education is hereby adopted in accordance with the attached annex.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

have decreed as follows

Article I

The texts of articles 22 and 23 of the mentioned Law Governing the Work of Engineering Consultancy Offices are hereby replaced with the following texts:

22. The licence to open consultancy offices is valid for a period of five years from the date of registration in the register, provided that the registration is renewed every five years from the date of registration or the previous renewal. and the Civil Associations Law issued by Royal Decree 14/2000,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 1(3) of the Civil Associations Law is hereby replaced with the following text:

3. Association: Every group of a continuous organisation comprising of several natural persons for a purpose other than making a profit and aims to carry out a social, cultural, or philanthropic activity, and this includes charity funds, social and cultural associations and clubs, and those established by private organisations, companies, or establishments irrespective of their name, and even if their activities include the practice of physical sport if this sport is not the primary activity of the association or club.

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its publication.
