Royal Decree 61/2022 on the Accession of the Sultanate of Oman to the International Convention for the Suppression of Acts of Nuclear Terrorism

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the International Convention for the Suppression of Acts of Nuclear Terrorism,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the International Convention for the Suppression of Acts of Nuclear Terrorism is hereby approved in the form attached, subject to the reservation on paragraph 1 of article 23 of the aforementioned convention.

Article II

The competent entities shall deposit the instrument of accession for the aforementioned convention in accordance with its provisions, subject to the aforementioned reservation.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 60/2022 Assigning the Competences Relating to Climate Affairs to the Environment Authority by Way of Transfer from the Civil Aviation Authority

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 33/2012 Establishing the Civil Aviation Authority,

the System of the Civil Aviation Authority promulgated by Royal Decree 43/2013,

the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 85/2020 regarding the Civil Aviation Authority,

and Royal Decree 106/2020 Establishing the Environment Authority, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

All the competences relating to climate affairs are hereby assigned to the Environment Authority by way of transfer from the Civil Aviation Authority in the manner provided in the attached annex.

Article II

All allocations, assets, rights, obligations, and holdings relating to climate affairs are hereby transferred to the Environment Authority from the Civil Aviation Authority.

Article III

The employees of the Civil Aviation Authority competent with climate affairs are hereby transferred to the Environment Authority with their same financial grades.

Article IV

The phrases “Civil Aviation Authority”,”Chairman of the Board of Directors of the Civil Aviation Authority” and “President of the Civil Aviation Authority”, wherever they occur in laws and royal decrees relating to climate affairs, are hereby replaced with the phrases “Environment Authority” and “President of the Environment Authority”, as the case may be.

Article V

The annex of the competences relating to climate affairs attached to the aforementioned Royal Decree 85/2020 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article VI

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 527/2022 Issuing the Regulation for Organising and Managing Exhibitions

Based on the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, and Adopting Its Organisational Structure,

and Ministerial Decision 182/2017 Issuing the Regulation for Organising and Managing Exhibitions,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to organising and managing exhibitions.

Article II

Commercial establishments engaged in the activity of organising and managing exhibitions shall reconcile their status in accordance with the provisions of the attached regulation within a period not exceeding 6 (six) months from the date of its entry into force.

Article III

The aforementioned Ministerial Decision 182/2017 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 59/2022 Amending Some Provisions of Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate and Its Executive Regulation

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate,

and Royal Decree 88/82 Adopting the Executive Regulation Governing the Usufruct of the Lands of the Sultanate,

and in pursuance of public interest,

have decreed as follows

Article I

The name of Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate is hereby replaced with “Governing the Usufruct of the Lands of the Sultanate of Oman”, and the name of Royal Decree 88/82 Adopting the Executive Regulation Governing the Usufruct of the Lands of the Sultanate is hereby replaced with “Adopting the Executive Regulation Governing the Usufruct of the Lands of the Sultanate of Oman”.

Article II

The attached amendments of the aforementioned Executive Regulation Governing the Usufruct of the Lands of the Sultanate of Oman shall be implemented.

Article III

The Minister of Housing and Urban Planning may amend the aforementioned Executive Regulation Governing the Usufruct of the Lands of the Sultanate of Oman, after the approval of the Council of Ministers.

Article IV

All that is contrary to this decree and the attached amendments, or in conflict with their provisions, is hereby repealed.

Article V

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Telecommunications Regulatory Authority: Decision 1152/2/3/2022/4 Issuing the Regulation Governing Telecommunication Towers

Based on the Telecommunications Law promulgated by Royal Decree 30/2002,

the Executive Regulation of the Telecommunications Law issued by Decision 144/2008,

and the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of telecommunication towers.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within one year from the date of its entry into force.

Article III

All that is contrary to the attached regulation, or in conflict with its provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on Royal Decree 84/2008 Issuing the Food Safety Law,

and Royal Decree 92/2020 Amending the Name of the Ministry of Agriculture and Fisheries to the Ministry of Agriculture, Fisheries, and Water Resources, Determining Its Competences, and Adopting Its Organisational Structure,

Ministerial Decision 2/2010 Issuing the Food Safety Regulation,

Ministerial Decision 49/2010 Issuing the Technical Regulation of Food Fortification,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to food fortification.

Article II

The aforementioned Decision 49/2010 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force after 6 (six) months from the date of its publication.

Royal Decree 58/2022 Issuing Class I Licence to Oman Tower Company to Build and Operate Passive Infrastructure for Telecommunications Towers

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Telecommunications Law promulgated by Royal Decree 30/2002,

and in pursuance of public interest,

have decreed as follows

Article I

A Class I Licence is hereby issued to Oman Tower Company to build and operate passive infrastructure for telecommunications towers, in accordance with the provisions of the attached licence.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Based on the Telecommunications Law promulgated by Royal Decree 30/2002,

the Executive Regulation of the Telecommunications Law issued by Decision 144/2008,

Decision 34/2012 regarding the Controls for Providing Public Voice Telecommunications Using Voice Over Internet Protocol Technology,

the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of the provision of voice or video telecommunications service over Internet Protocol.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within 3 (three) months from the date of its entry into force.

Article III

The aforementioned decision 34/2012 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on the Majlis Al-Shura Elections Law promulgated by Royal Decree 58/2013,

the Municipal Councils Law promulgated by Royal Decree 126/2020,

Ministerial Decision 44/2019 Regarding Determining the Rules, Means, Procedures, and Fees of Election Advertising,

the Governance Regulation of the Elections of the Members of the Municipal Council issued by Ministerial Decision 92/2022,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The attached annex shall apply in regard to the rules, means, procedures, and fees of election advertising for the elections of members of Majlis Al-Shura and members of municipal councils.

Article II

The aforementioned Ministerial Decision 44/2019 is hereby repealed, as well as all that is contrary to the attached annex or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached Governance Regulation for the Establishment, Management, and Operation of Jetties Outside Ports shall apply.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within 6 (six) months from the date of its entry into force.

Article III

All that is contrary to the attached regulation, or in conflict with its provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
