Ministry of Commerce and Industry: Ministerial Decision 72/2020 Issuing the Executive Regulation of the Foreign Capital Investment Law

Arabic Consolidated Text

Based on the Foreign Capital Investment Law promulgated by Royal Decree 50/2019,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached Executive Regulation of the Foreign Capital Investment Law shall apply.

Article II

All that is contrary to the attached regulation, or in conflict with its provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 64/2020 Establishing‌ ‌the‌ ‌Cyber‌ ‌Defence‌ ‌Centre‌ ‌and‌ ‌Issuing‌ ‌Its‌ ‌System‌

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Telecommunications Law promulgated by Royal Decree 30/2002,

Royal Decree 63/2003 regarding the National Security Council,

the Electronic Transactions Law promulgated by Royal Decree 69/2008,

the Cybercrime Law promulgated by Royal Decree 12/2011,

and the Internal Security Service Law promulgated by Royal Decree 4/2020,

and in pursuance of public interest,

have decreed as follows

Article I

A centre named the “Cyber Defence Centre” is hereby established subordinate to the Internal Security Service and governed by the provisions of the attached system.

Article II

The Chairman of the Internal Security Service shall issue the necessary regulations and decisions for implementing the provisions of the attached system.

Article III

All that is contrary to this decree and the attached system, or is in conflict with their provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 63/2020 Ratifying the Agreement between the Sultanate of Oman and the Slovak Republic for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with Respect to Taxes on Income

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Agreement between the Sultanate of Oman and the Slovak Republic for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with Respect to Taxes on Income signed in the city of Muscat on 25 March 2018,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 59/2020 Establishing the Private Office

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Law concerning the Financial System of the Diwan of Royal Court Issued by Royal Decree 128/91,

the Law on Pensions and End of Service Gratuity for Omani Employees of the Diwan of Royal Court promulgated by Royal Decree 86/96,

and the Law concerning the Employee System of the Diwan of Royal Court promulgated by Royal Decree 97/97,

and in pursuance of public interest,

have decreed as follows

Article I

An office named the “Private Office” is hereby established directly subordinate to His Majesty the Sultan, and its organisational structure shall be adopted by royal decree.

Article II

The competences of the Private Office are hereby determined in accordance with the attached annex.

Article III

The Private office shall have a chairman appointed by royal decree and assisted by a sufficient number of employees from a variety of disciplines relevant to the work of the office.

Article IV

The provisions of the Law concerning the Financial System of the Diwan of Royal Court, the Law on Pensions and End of Service Gratuity for Omani Employees of the Diwan of Royal Court, and the Law concerning the Employee System of the Diwan of Royal Court, shall apply to the Private Office and its employees, and the Chairman of the Private Office shall have the authorities of the minister stipulated in these laws.

Article V

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 58/2020 Approving the Accession of the Sultanate of Oman to the Minamata Convention on Mercury

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Minamata Convention on Mercury done at Kumamoto, Japan on 10 October 2013,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the Minamata Convention on Mercury is hereby approved in the form attached.

Article II

Competent bodies shall deposit the instrument of accession for the aforementioned convention in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 119/94 Approving the Accession of the Sultanate of Oman to Some International Agreements,

and the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from Their Utilization to the Convention on Biological Diversity done at Nagoya on 29 October 2010,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from Their Utilization to the Convention on Biological Diversity is hereby approved in the form attached.

Article II

Competent bodies shall deposit the instrument of accession for the aforementioned protocol in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 46/2020 Approving the Accession of the Sultanate of Oman to the International Covenant on Economic, Social, and Cultural Rights

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the International Covenant on Economic, Social and Cultural Rights done in New York on 16 December 1966,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the International Covenant on Economic, Social and Cultural Rights is hereby approved in the form attached, subject to the reservation on the provisions of clauses (a) and (d) of paragraph 1 of article 8 of the aforementioned covenant relating to the right to form trade unions and the right to strike, in relation to employees in governmental units.

Article II

Competent bodies shall deposit the instrument of accession to the aforementioned covenant in accordance with its provisions, subject to the aforementioned reservation.

Article III

This decree shall be published in the Official Gazette and shall come into force on the date of its issuance.

Royal Decree 44/2020 Approving the Accession of the Sultanate of Oman to the International Convention for the Protection of All Persons from Enforced Disappearance

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the International Convention for the Protection of All Persons from Enforced Disappearance done in New York on 20 December 2006,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the International Convention for the Protection of All Persons from Enforced Disappearance is hereby approved in the form attached, subject to the following reservation:

First: The Sultanate of Oman declares that it does not recognise the competence of the Committee on Enforced Disappearances stipulated in article 33 of the aforementioned convention.

Second: The Sultanate of Oman declares that it is not bound by the provisions of paragraph 1 of article 42 of the aforementioned convention.

Article II

Competent bodies shall deposit the instrument of accession to the aforementioned convention in accordance with its provisions, subject to the aforementioned reservation.

Article III

This decree shall be published in the Official Gazette and shall come into force on the date of its issuance.
