Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 67/2023 Deeming an Omani Standard Specification Binding

Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and Ministerial Decision 12/2012 Adopting the Gulf Technical Regulation 246/2011 regarding the Labels of Tobacco Products Packaging as a Binding Omani Standard Specification,

and in pursuance of public interest,

it is hereby decided

Article I

Omani Standard Specification OS 1655:2022 for Plain Packaging of Tobacco Products is hereby deemed a binding Omani standard specification.

Article II

An administrative fine not exceeding 1,000 (one thousand) Rial Omani shall be imposed on anyone who violates the provisions of this decision, and the fine shall be doubled if the violation is repeated.

Article III

The aforementioned Ministerial Decision 12/2012 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force after the lapse of 6 (six) months from the date of its publication.

Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to governing the licensing of the national product brand.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status within 1 (one) year from the date of its entry into force.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Arabic Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure, and in pursuance of public interest,

it is hereby decided

Article I

The Gulf standard GSO 2698:2022 for the technical requirements for electric vehicles is hereby deemed as a binding Omani standard specification.

Article II

An administrative fine not exceeding 1,000 (one thousand) Rial Omani shall be imposed on anyone who violates the provisions of this decision, and the fine shall be doubled if the violation is repeated.

Article III

the Commercial Companies Law promulgated by Royal Decree 18/2019,

the Foreign Capital Investment Law promulgated by Royal Decree 50/2019,

and Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of the procedures for identifying the beneficial owner.

Article II

Commercial companies shall rectify their status in accordance with the provisions of the attached regulation within one month from the date of its entry into force.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

the Regulation on the Procedures for Implementing the Security Council Resolutions Issued under Chapter VII of the Charter of the United Nations on the Prevention and Suppression of Terrorism and Its Financing and on the Prevention, Suppression, and Obstruction of the Proliferation of Weapons of Mass Destruction and Its Financing issued by Decision 1/2021,

and Ministerial Decision 198/2021 Issuing the Regulation on the Supervision of Accountants, Auditors, Accounting and Auditing Offices and Firms and Precious Metals and Valuable Gemstones Establishments and Firms regarding Anti-money Laundering and Counter-terrorist Financing,

it is hereby decided

Article I

The attached Regulation on the Supervision of Accounting and Auditing Offices and Firms and Precious Metals and Valuable Gemstones Establishments and Firms regarding Anti-money Laundering and Counter-terrorist Financing shall apply.

Article II

Accounting and auditing offices and firms and precious metals and valuable gemstones establishments and firms shall rectify their status in accordance with the provisions of the attached regulation within one month from the date of its entry into force.

Article III

The aforementioned decision 198/2021 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of the practice of the activity of marketing and promotion on internet websites and social media.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within 6 (six) months from the date of its entry into force.

Article III

This decision shall be published in the Official Gazette, and comes into force after 90 (ninety) days from the date of its publication.

Article I

The provisions of the attached regulation shall apply in regard to the governance of foreign investor applications approval offices.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, and Adopting Its Organisational Structure,

and Ministerial Decision 182/2017 Promulgating the Regulation for Organising and Managing Exhibitions,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to organising and managing exhibitions.

Article II

Commercial establishments engaged in the activity of organising and managing exhibitions shall reconcile their status in accordance with the provisions of the attached regulation within a period not exceeding 6 (six) months from the date of its entry into force.

Article III

The aforementioned Ministerial Decision 182/2017 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 519/2022 regarding the Ban on Importing Plastic Bags

Arabic Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure, and in pursuance of public interest,

it is hereby decided

Article I

Companies, establishments, and individuals are hereby banned from importing plastic bags.

Article II

Without prejudice to any punishment more severe stipulated in any other law, an administrative fine of 1,000 (one thousand) Rial Omani shall be imposed on anyone who violates the provisions of this decision, and it shall be doubled if the violation is repeated.

Article III

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article IV

Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 498/2022 Naming the Chair and Members of the Elections Contestation Committee of the Oman Chamber of Commerce and Industry

Based on the System of the Oman Chamber of Commerce and Industry promulgated by Royal Decree 56/2022,

and the Governance Regulation of the Elections Committees of the Oman Chamber of Commerce and Industry issued by Ministerial Decision 225/2017,

and in pursuance of public interest,

it is hereby decided

Article I

The Elections Contestations Committee of the Oman Chamber of Commerce and Industry shall be chaired by the Honourable Judge Dr Thani bin Salim bin Mubarak Al-Amri, a judge of the Court of Appeal in Muscat, and the membership of:

1. Mr Qassim bin Salim bin Hamdan Al-Ghafri – Assistant Public Prosecutor.

2. The Honourable Judge Dr Yousef bin Said bin Subai Al-Rashdi—a primary court judge.

3. The Honourable Judge Dr Ayman bin Mohammed bin Harib Al-Balushi—a primary court judge.

4. The Honourable Judge Ayman bin Ali bin Mohammed Al-Zaabi—a primary court judge.

Mr Mohammed bin Salim bin Saad Al-Hashimi—a Senior Legal Researcher at the Ministry of Commerce, Industry, and Investment Promotion shall be the secretary of the committee.

Article II

The committee shall exercise the competences stipulated in the aforementioned Governance Regulation of the Elections Committees of the Oman Chamber of Commerce and Industry.

Article III

This decision shall be published in the Official Gazette, and comes into force on the date of its issuance.
