Royal Decree 119/2006 Amending Some Provisions of the Civil and Commercial Procedure Law

Arabic

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Civil and Commercial Procedures Law issued by Royal Decree 29/2002,

and in pursuance of public interest,

have decreed as follows

Article I

The phrase “in two widely circulated daily newspapers” provided in article 11 of the mentioned Civil and Commercial Procedures Law is hereby replaced with the phrase “in a widely circulated daily newspaper”.

Article II

Article 74bis is hereby added to the mentioned Civil and Commercial Procedures Law, with the following text:

The Minister of Justice shall issue a regulation governing judicial aid to insolvent persons after agreement in regard to it with the Ministry of Finance.

Article III

This decree must be published in the Official Gazette, and comes into force on the day following the date of its publication.

Darwish bin Ismail bin Ali Al-Balushi is hereby appointed Secretary General of the Ministry of Finance with the rank of minister.

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 117/2006 Forming a Ministerial Committee for Tourism

Arabic We, Qaboos bin Said, the Sultan of Oman after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96, and the Tourism Law promulgated by Royal Decree 33/2002, and in pursuance of public interest,

have decreed as follows

Article I

A ministerial committee for tourism is hereby formed under the chairmanship of the Minister of National Economy and Supervisor of the Ministry of Finance and the membership of the following:
The Minister of Tourism Deputy Chairman
The Inspector General of Police and Customs Member
The Minister of Commerce and Industry Member
The Minister of Housing, Electricity, and Water Member
The Minister of Transport and Communications Member
The Minister of Regional Municipalities, Environment, and Water Resources Member

Article II

The committee is competent with the development of the tourism sector and for this purpose it may:

– Set the necessary policies to activate the tourism sector.

– Approve the necessary systems to stimulate tourism.

– Approve projects that contribute effectively to the development of the tourism sector.

– Set the necessary mechanisms to address the problems and overcome the obstacles facing the tourism sector.

Article III

The committee shall convene upon the invitation of its chairman whenever the need arises.

Article IV

Saud bin Salim bin Ali Al-Balushi is hereby appointed Undersecretary of the Ministry of Education for Educational Planning and Human Resources Development.

Article II

Mohammed bin Hamdan Al-Tubi is hereby appointed an advisor in the Ministry of Education with his same grade and financial entitlements.

Article III

Royal Decree 112/2006 Amending Some Provisions of the Labour Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Labour Law issued by Royal Decree 35/2003,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 109 of the mentioned Labour Law is hereby replaced with the following text:

The labour unions shall form a General Federation for Workers of the Sultanate of Oman to represent them in local, regional, and international meetings and conferences. Labour unions are permitted to form labour federations among themselves.

Article II

The text of article 110 of the mentioned Labour Law is hereby replaced with the following text:

Labour unions, labour federations, and the General Federation for Workers of the Sultanate of Oman enjoy independent legal personality, from the date of registration with the ministry, and they have the right to exercise their activities with complete freedom without interference in or influence over their affairs.

The minister shall issue the decisions governing the formation, work, and registration of labour unions, labour federations, and the General Federation for Workers of the Sultanate of Oman.

Article III

The text of article 110bis of the mentioned Labour Law is hereby replaced with the following text:

It is not permitted to impose the punishment of dismissal or any other punishment on representatives of workers in labour unions, labour federations, or the General Federation for Workers of the Sultanate of Oman because of the exercise of their labour union activities in accordance with this law and the ministerial decisions implementing it.

Article IV

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

His Highness Sayyid Ali bin Saif bin Hamoud Al-Said—Secretary General in the Office of the Minister of the Diwan of Royal Court—is hereby granted the rank of minister.

Article II

Royal Decree 108/2006 Establishing a Governorate

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the Law Governing the Administrative Apparatus of the State issued by Royal Decree 26/75 and its amendments,

Royal Decree 6/91 Adopting the Administrative Division of the Sultanate and its amendments,

the Civil Service Law issued by Royal Decree 120/2004 and its amendments,

and Royal Decree 3/2003 Adopting the Organisational Structure of the Ministry of Interior,

and in pursuance of public interest,

have decreed as follows

Article I

A governorate named the Governorate of Buraimi is hereby established, comprising the Wilayat of Buraimi, Mahdah, and Sunainah. It must be within the administrative divisions of the Ministry of Interior and under the direct supervision of its minister.

Article II

The headquarters of the governor must be in the Wilayat of Buraimi. His mandates must be issued by a decision by the Minister of Interior after the approval of the Council of Ministers, and he must be granted the special grade.

Article III

The annex attached to the mentioned Royal Decree 6/91 is hereby amended in accordance with the provisions of this decree.

Article IV

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.
