Royal Decree 118/2020 Amending Some Provisions of the Income Tax Law

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Income Tax Law promulgated by Royal Decree 28/2009,

Royal Decree 66/2019 Establishing the Tax Authority,

the System of the Tax Authority and the Adoption of Its Organisational Structure promulgated by Royal Decree 42/2020,

after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned Income Tax Law shall be implemented.

Article II

The phrase “Minister of Finance” wherever it occurs in the aforementioned Royal Decree 28/2009 is hereby replaced with the phrase “Chairman of the Tax Authority.”

Article III

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication, with the exception of article 140 of the aforementioned Income Tax Law which comes into force from the tax year starting on 1 January 2020, or the tax years following it.

Royal Decree 117/2020 Forming the Board of Governors of the Central Bank of Oman

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, and the Banking Law promulgated by Royal Decree 114/2000, and in pursuance of public interest,

have decreed as follows

Article I

The Board of Governors of the Central Bank of Oman is hereby formed under the chairmanship of His Highness Sayyid Taimur bin Asaad bin Tarik Al-Said and with the membership of the following: – Minister of Economy as deputy chairman – Undersecretary of the Ministry of Finance – Executive President of the Capital Market Authority – Maqbool bin Ali bin Sultan Al-Lawati – Sheikh Mohammed bin Saud bin Salim Bahwan Al-Mukhaini – Ahmed bin Mohammed bin Abdullah Al-Abri The membership is for a period of five years from the date of entry into force of this decree.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

Royal Decree 116/2020 Amending Some Provisions of Royal Decree 6/2020 regarding the Higher Committee for National Day Celebrations

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and Royal Decree 6/2020 regarding the Higher Committee for National Day Celebrations,

and in pursuance of public interest,

have decreed as follows

Article I

The name of the “Higher Committee for National Day Celebrations” stated in the aforementioned Royal Decree 6/2020 is hereby replaced with the name “Secretariat General for National Celebrations.”

Article II

A new article is hereby added to the aforementioned Royal Decree 6/2020 with the following text:

Article IV bis

An executive committee is hereby formed in the Secretariat General for National Celebrations under the chairmanship of the Secretary General, and by the membership of representatives – each of whom has a rank no less than undersecretary or equivalent – of the following bodies:

– Ministry of Interior.

– Ministry of Finance.

– Ministry of Information.

– Ministry of Education.

– Ministry of Commerce, Industry, and Investment Promotion.

– Secretariat General of the Council of Ministers.

– Royal Oman Police.

The membership of the committee also includes a representative of the Chief of Staff of the Sultan’s Armed Forces and the Royal Protocol.

Article III

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article IV

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 114/2020 Approving the Accession of the Sultanate of Oman to the Convention on the Contract for the International Carriage of Goods by Road (CMR) and the Additional Protocol concerning the Electronic Consignment Note

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Convention on the Contract for the International Carriage of Goods by Road (CMR) done in Geneva on 19 May 1956,

and the Additional Protocol to the Convention on the Contract for the International Carriage of Goods by Road (CMR) concerning the Electronic Consignment Note done in Geneva on 20 February 2008,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the Convention on the Contract for the International Carriage of Goods by Road (CMR) is hereby approved in the form attached, and the Sultanate declares that it is not bound by the provisions of article 47 of the aforementioned convention.

Article II

The accession of the Sultanate of Oman to the Additional Protocol to the Convention on the Contract for the International Carriage of Goods by Road (CMR) concerning the Electronic Consignment Note is hereby approved in the form attached, and the Sultanate declares that it is not bound by the provisions of article 11 of the aforementioned protocol.

Article III

Competent bodies shall deposit the instrument of accession to the aforementioned convention and protocol in accordance with their provisions, subject to the reservations stipulated in article I and article II.

Article IV

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Omani Nationality Law promulgated by Royal Decree 38/2014,

and in pursuance of public interest,

have decreed as follows

Article I

Omani nationality is hereby granted to those named in the attached list.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 88/2020 Merging the Ministry of Justice and the Ministry of Legal Affairs into One Ministry Named the Ministry of Justice and Legal Affairs, Determining Its Competences, and Adopting Its Organisational Structure

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 2/94 Amending the Ministerial Composition,

Royal Decree 14/94 Determining the Competences of the Ministry of Legal Affairs,

Royal Decree 114/94 Adopting the Organisational Structure of the Ministry of Legal Affairs,

Royal Decree 47/2000 Determining the Competences of the Ministry of Justice and Adopting Its Organisational Structure,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The “Ministry of Justice” and the “Ministry of Legal Affairs” are hereby merged into one ministry named the “Ministry of Justice and Legal Affairs,” and its competences are hereby determined in accordance with the attached Annex 1.

Article II

The organisational structure of the Ministry of Justice and Legal Affairs is hereby adopted in accordance with the attached Annex 2.

Article III

All allocations, assets, rights, obligations, and holdings of the Ministry of Legal Affairs are hereby transferred to the Ministry of Justice and Legal Affairs, and its employees are hereby transferred to the Ministry of Justice and Legal Affairs with their same financial grades.

Technical members of the Ministry of Legal Affairs are hereby also transferred to it with their same financial grades and entitlements, as well as their employment status.

Article IV

Without prejudice to the provisions of article V of this decree, all allocations, assets, rights, obligations, and holdings of the Ministry of Justice are hereby transferred to the Ministry of Justice and Legal Affairs, and its employees are hereby transferred to: the Ministry of Justice and Legal Affairs—including employees of the divisions relating to expert undertakings before the courts and lawyers affairs—; the Ministry of Interior; the Ministry of Endowments and Religious Affairs; the Secretariat General of the Council of Administrative Affairs for the Judiciary; and the Governorates of Muscat, Dhofar, and Musandam with their same financial grades, in accordance with the rules determined by the Council of Ministers.

Article V

All competences, allocations, assets, rights, obligations, and holdings of the divisions relating to mediation and conciliation in the Ministry of Justice are hereby transferred to the Ministry of Interior and the Governorates of Muscat, Dhofar, and Musandam—as the case may be—, and the employees of these divisions are also hereby transferred to those bodies—each according to their competence—with their same financial grades. 

All competences, allocations, assets, rights, obligations, and holdings of the Directorate General for the Management and Investment of Orphans and Minors Funds in the Ministry of Justice are hereby transferred to the Ministry of Endowments and Religious Affairs, and its employees are hereby transferred to the Ministry of Endowments and Religious Affairs with their same financial grades.

All competences, allocations, assets, rights, obligations, and holdings of the divisions relating to the public notary in the Ministry of Justice are also hereby transferred to the Council of Administrative Affairs for the Judiciary, and the employees of these divisions are hereby transferred to the Secretariat General of the Council of Administrative Affairs for the Judiciary with their same financial grades.

Article VI

The phrases “Ministry of Justice”; “Ministry of Legal Affairs”; “Minister of Justice”; and “Minister of Legal Affairs” wherever they occur in laws and royal decrees relating to legal affairs, expert undertakings before the courts, and advocacy are hereby replaced with the phrases “Ministry of Justice and Legal Affairs” and “Minister of Justice and Legal Affairs.” 

The phrases “Ministry of Justice” and “Minister of Justice” wherever they occur in laws and royal decrees relating to mediation and conciliation are hereby replaced with the phrases “Ministry of Interior”; “Governorate of Muscat”; “Governorate of Dhofar”; “Musandam Governorate”; “Minister of Interior”; “Minister of State and Governor of Muscat”; “ Minister of State and Governor of Dhofar”; and “Minister of State and Governor of Musandam” as the case may be. 

The phrases “Ministry of Justice” and “Minister of Justice,” wherever they occur in laws and royal decrees relating to the public notary are also hereby replaced with the phrases “Council of Administrative Affairs for the Judiciary” and “Chairman of Council of Administrative Affairs for the Judiciary.”

Article VII

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VIII

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

after perusal of the Basic Statute of the State,

Royal Decree 24/2003 Establishing the Public Authority for Craft Industries,

Royal Decree 53/2003 Issuing the System of the Public Authority for Craft Industries and Adopting Its Organisational Structure,

Royal Decree 91/2020 Amending the Name of the Ministry of Heritage and Culture to the Ministry of Heritage and Tourism, Determining Its Competences, and Adopting Its Organisational Structure,

and Royal Decree 107/2020 Establishing the Small and Medium Enterprises Development Authority, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

All allocations, assets, rights, obligations, and holdings relating to heritage in the Public Authority for Craft Industries are hereby transferred to the Ministry of Heritage and Tourism.

All allocations, assets, rights, obligations, and holdings relating to development, training, and support of craftsmen in the Public Authority for Craft Industries are hereby transferred to the Small and Medium Enterprises Development Authority.

Article II

The employees concerned with heritage in the Public Authority for Craft Industries are hereby transferred to the Ministry of Heritage and Tourism, and the rest of its employees are hereby transferred to the Small and Medium Enterprises Development Authority, with their same financial grades, in accordance with the rules determined by the Council of Ministers.

Article III

The Public Authority for Craft Industries is hereby abolished, and all that is contrary to this decree or in conflict with its provisions is hereby repealed.

Article IV

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 106/2020 Establishing the Environment Authority, Determining Its Competences, and Adopting Its Organisational Structure

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 90/2007 Establishing a Ministry for Environment and Climate Affairs,

Royal Decree 18/2008 Determining the Competences of the Ministry of Environment and Climate Affairs and Adopting Its Organisational Structure,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

A public authority named the "Environment Authority" is hereby established. It shall have legal personality, shall enjoy financial and administrative independence, and shall be subordinate to the Council of Ministers.

Article II

The headquarters of the Environment Authority shall be in the Governorate of Muscat, and branches of it may be established in the other governorates by a decision of the board of directors.

Article III

The competences of the Environment Authority are hereby determined in accordance with the attached Annex 1.

Article IV

The organisational structure of the Environment Authority is hereby adopted in accordance with the attached Annex 2.

Article V

Without prejudice to the provisions of Royal Decree 85/2020 Regarding the Public Authority for Civil Aviation, all allocations, assets, rights, obligations, and holdings of the Ministry of Environment and Climate Affairs relating to the environment are hereby transferred to the Environment Authority.

Article VI

The employees of the Ministry of Environment and Climate Affairs, with the exception of employees concerned with climate affairs, are hereby transferred to the Environment Authority with their same financial grades, in accordance with the rules determined by the Council of Ministers.

Article VII

The phrase “Ministry of Environment and Climate Affairs” wherever it occurs in laws and royal decrees relating to the environment is hereby replaced with the phrase “Environment Authority.”

The phrase “Minister of Environment and Climate Affairs” wherever it occurs in laws and royal decrees relating to the environment is also hereby replaced with the phrases “Chairman of the Board of Directors of the Environment Authority” or “President of the Environment Authority” as the case may be.

Article VIII

The Ministry of Environment and Climate Affairs is hereby abolished, and all that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article IX

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 6/2002 Determining the Competences of the Ministry of Higher Education and Adopting Its Organisational Structure,

Royal Decree 30/2010 Issuing the Law of the Research Council,

Royal Decree 76/2004 Determining the Competences of the Ministry of Manpower and Adopting Its Organisational Structure,

Royal Decree 54/2005 Establishing the Research Council and Determining Its Competences,

Royal Decree 104/2005 Establishing the Unified Admission Centre,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The name of the “Ministry of Higher Education” is hereby amended to the “Ministry of Higher Education, Research, and Innovation” and its competences are hereby determined in accordance with the attached Annex 1.

Article II

The organisational structure of the Ministry of Higher Education, Research, and Innovation is hereby adopted in accordance with the attached Annex 2.

Article III

All allocations, assets, rights, obligations, and holdings of the Research Council; its Secretariat General; and the Directorate General of Vocational Training and the Directorate General of Occupational Standards and Curriculum Development in the Ministry of Manpower are hereby transferred to the Ministry of Higher Education, Research, and Innovation.

Article IV

The employees of the Research Council, its Secretariat General, and the Directorate General for Vocational Training and the Directorate General of Occupational Standards and Curriculum Development in the Ministry of Manpower are hereby transferred to the Ministry of Higher Education, Research, and Innovation with their same financial grades.

Article V

The phrase “Chairman of the Research Council” wherever it occurs in law and royal decrees is hereby replaced with the phrase “Minister of Higher Education, Research, and Innovation.”

Article VI

The Research Council and its Secretariat General are hereby abolished, and all that is contrary to this decree or in conflict with its provisions is hereby repealed.

Article VII

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.
