Royal Decree 28/2019 Ratifying the Paris Agreement

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

Royal Decree 119/94 Approving the Accession of the Sultanate of Oman to Some International Agreements,

and the Paris Agreement done in Paris on 12 December 2015, and signed by the Sultanate on 22 April 2016,   

and after presentation to Majlis Al-Shura,

and in pursuance of public interest,

have decreed as follows

Article I 

The aforementioned agreement is hereby ratified in the form attached.

Article II

Competent bodies shall deposit the instrument of ratification of the aforementioned agreement in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 27/2019 regarding Scientific Zones and Other Specialised Zones

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

Royal Decree 5/81 Governing the Usufruct of Lands of the Sultanate for Foreigners and Companies,

the Foreign Capital Investment Law promulgated by Royal Decree 102/94,

Royal Decree 67/2003 Applying the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf,

the Law of the Research Council promulgated by the Royal Decree 30/2010,

and the Commercial Companies Law promulgated by Royal Decree 18/2019,

and in pursuance of public interest,

have decreed as follows

Article I

Scientific zones subordinate to the Research Council, and any scientific or other specialised zones, shall be established upon the approval of the Council of Ministers. Establishments and companies operating in these zones shall enjoy exemption, incentives, and facilities stipulated in the attached annex.

Article II

All that is contrary to this decree, and the annex attached to it, or is in conflict with their provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 26/2019 Promulgating Amendments to Some Provisions of the Law on the Classification of State Records and the Governance of Protected Places

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Law on the Classification of State Records and the Governance of Protected Places promulgated by Royal Decree 118/2011,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned Law on the Classification of State Records and the Governance of Protected Places shall apply.

Article II

All that is contrary to the attached law, or is in conflict with its provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 23/2019 Promulgating the Excise Tax Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Banking Law promulgated by Royal Decree 114/2000,

and Royal Decree 67/2003 Applying the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Excise Tax Law shall apply.

Article II

The Minister Responsible for Financial Affairs shall issue the executive regulation of the attached law within a period not exceeding 6 (six) months from the date of its entry into force.

Article III

All that is contrary to the attached law, or is in conflict with its provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the lapse of 90 (ninety) days from the date of its publication.

Royal Decree 22/2019 Establishing the National Centre for Recruitment and Promulgating Its System

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Public Authorities and Establishments System promulgated by Royal Decree 116/91,

Royal Decree 76/2004 Determining the Competences of the Ministry of Manpower and Approving Its Organisational Structure,

and Royal Decree 98/2011 Establishing the Public Authority of Manpower Register and Promulgating Its System,

and in pursuance of public interest,

have decreed as follows

Article I

A centre named the “National Centre for Recruitment” is hereby established subordinate to the Council of Ministers, and it shall be governed by the provisions of the attached system.

Article II

The National Centre for Recruitment shall enjoy legal personality, as well as financial and administrative independence.

Article III

The competences, allocations, and assets of the Public Authority of Manpower Register shall be transferred to the National Centre for Recruitment, as well as all that is connected to the competences of the centre from the Ministry of Manpower.

Article IV

The employees of the Public Authority of Manpower Register shall be transferred to the National Centre for Recruitment, with the same employment status. In coordination with the relevant bodies, it is permitted to transfer any employee of the units of the state administrative apparatus (civil, military, and security) to the centre with the same employment status according to the needs and nature of the work of the centre.

Article V

All units of the state administrative apparatus (civil, military, and security) and private sector establishments shall provide the National Centre for Recruitment with vacancies, jobs, and professions to be occupied in coordination with competent bodies.

Article VI

Amendment to the attached system of the National Centre for Recruitment shall be by the chairman of the board of directors of the National Centre for Recruitment after the approval of the Council of Ministers.

Article VII

The chairman of the board of directors of the National Centre for Recruitment shall issue the regulations and decisions necessary for implementing the provisions of the attached system, and until these regulations and decisions are issued, the laws and regulations applicable to the units of the state administrative apparatus shall operate, in regard to that which is not governed by a special text in this decree and the attached system, and to the degree they do not contradict with their provisions.

Article VIII

The aforementioned Royal Decree 98/2011 is hereby repealed, as well as all that is contrary to this decree, and the attached system, or is in conflict with their provisions. 

Article IX

This decree shall be published in the Official Gazette, and comes into force on 1 January 2020.

Royal Decree 19/2019 Promulgating the Mineral Resources Law

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Law on Expropriation for Public Benefit promulgated by Royal Decree 64/78,

the Protection of National Heritage Law promulgated by Royal Decree 6/80,

Royal Decree 15/81 Concerning the Territorial Sea, Continental Shelf, and Exclusive Economic Zone,

the Law Governing the Accounting and Audit Profession promulgated by Royal Decree 77/86,

the Financial Law promulgated by Royal Decree 47/98,

the Water Resources Protection Law promulgated by Royal Decree 29/2000,

the Environment Protection and Pollution Prevention Law promulgated by Royal Decree 114/2001,

the Nature Reserves and Wildlife Conservation Law promulgated by Royal Decree 6/2003,

the Mining Law promulgated by Royal Decree 27/2003,

the Labour Law promulgated by Royal Decree 35/2003,

and Royal Decree 79/2013 Promulgating the System of the Special Economic Zone at Duqm,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Mineral Resources Law shall apply.

Article II

The board of directors of the Public Authority for Mining shall issue the executive regulation for this law within a maximum period of 1 (one) year from the date of its issuance, and the decisions necessary for implementing its provisions, and until they are issued, the existing regulations and decisions shall continue to operate to the degree that they do not contradict with its provisions.

Article III

Exploitation agreements made, and licences issued, prior to the entry into force of this law shall continue to apply, provided their renewal is in accordance with the provisions prescribed herein.

Decisions concerning licence requests submitted prior to the entry into force of this law shall be in accordance with the procedures and controls stipulated herein.

Article IV

The Mining Law promulgated by Royal Decree 27/2003 is hereby repealed, as well as every provision contrary to this law or in conflict with its provisions.

Article V

This decree shall be published in the Official Gazette, and comes into force the day after the lapse of 30 (thirty) days from the date of its publication.

Royal Decree 18/2019 Promulgating the Commercial Companies Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Commercial Companies Law promulgated by Royal Decree 4/74,

and the Capital Market Law promulgated by Royal Decree 80/98,

and after presentation to Majlis Oman, 

and in pursuance of public interest,

have decreed as follows

Article I

The attached Commercial Companies Law shall apply.

Article II

The Minister of Commerce and Industry and the Chairman of the Capital Market Authority, each according to his competence, shall issue the regulations implementing this law within a period not exceeding one year from the date of its entry into force, and they shall issue the decisions necessary to implement the provisions of this law, and until they are issued the existing regulations and decisions shall continue to operate to the degree that they do not contradict with the provisions of this law. 

Article III

Commercial companies existing at the date of entry into force of this law shall rectify their status within one year from the date of its entry into force.

Article IV

The Commercial Companies Law promulgated by Royal Decree 4/74 is hereby repealed, as well as every provision contrary to this law or in conflict with its provisions.

Article V

This decree shall be published in the Official Gazette, and comes into force after 60 (sixty) days from its publication.

the Law of Sea Fishing and Protection of Aquatic Living Resources promulgated by Royal Decree 53/81,

the Law Governing Maritime Navigation in Territorial Waters promulgated by Royal Decree 98/81,

the Environment Protection and Pollution Prevention Law promulgated by Royal Decree 114/2001,

and the Nature Reserves and Wildlife Conservation Law promulgated by Royal Decree 6/2003,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Aquatic Living Resources Law shall apply.

Article II

The Minister of Agriculture and Fisheries shall issue the executive regulation for the provisions of this law within a period not exceeding one year from the date of its issuance, and shall issue the decisions necessary to implement the provisions of this law, and until they are issued, the regulation and decisions in force shall continue to operate to the degree that they do not contradict with the provisions of this law.

Article III

The Law on Fishing and Protection of Marine Living Resources promulgated by Royal Decree 53/81 is hereby repealed, as well as every provision contrary to this law or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force after 90 (ninety) days from the date of its publication.

Royal Decree 15/2019 Renewing Class I Licence for Oman Telecommunications Company SAOG to Provide Basic Mobile General Telecommunications Services

A Class I Licence for Oman Telecommunications Company (SAOG) to Provide Basic Mobile Public  Telecommunications Services is hereby renewed in accordance with the provisions of the licence attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on 11 February 2019.
