Royal Decree 6/2022 Issuing the Personal Data Protection Law

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Electronic Transactions Law promulgated by Royal Decree 69/2008,

and Royal‌ ‌Decree‌ ‌64/2020‌ ‌Establishing‌ ‌the‌ ‌Cyber‌ ‌Defence‌ ‌Centre‌ ‌and‌ ‌Issuing‌ ‌Its‌ ‌System‌,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Personal Data Protection Law shall apply.

Article II

The Minister of Transport, Communications, and Information Technology shall issue the executive regulation of the attached law and shall also issue the necessary decisions for implementing its provisions, and until they are issued, the existing regulations and decisions continue to operate to the degree that they do not contradict with it.

Article III

Chapter seven of the aforementioned Electronic Transactions Law is hereby repealed, as well as all that is contrary to the attached law or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force after the lapse of one year from the date of its issuance.

COVID-19 Supreme Committee Decision of 9 February 2022

Statement of the Supreme Committee

The COVID-19 Supreme Committee, within the framework of its continuous convening, has been observing the development of the pandemic, the precautionary procedures, and the means for limiting its spread. The Supreme Committee reviewed the reports regarding the state of the COVID-19 pandemic, which indicate a flattening of the curve of positive cases, a fact further supported by the stabilisation of the percentage of positive tests, notwithstanding the increase in the number of admitted patients in COVID-19 wards or ICU. In light of the foregoing, the Supreme Committee makes following decisions, which shall be implemented from the date of the publication of this statement:

First: Holding Friday prayers and continuing holding the five daily prayers provided that the number of worshippers does not exceed 50% of the capacity of the mosque, while taking all prescribed precautions in this regard.

Second: Ending the decision to reduce the number of employees required to attend workplaces in the administrative units of the state and other public legal persons. The Supreme Committee calls all entities to continue to undertake precautionary and preventive measures necessary to prevent the spread of the disease and to monitor the compliance of everyone to them.

Third: Permitting the operation of activity venues at 70% of their capacity provided that all attendees receive the COVID-19 vaccine, and the adherence to all preventive procedures and requirements.

Fourth: Permitting the holding of international and regional conferences and exhibitions as well as activities of a public nature, provided that organisers adhere to the requirements provided for practising such activities, especially the prohibition of exceeding 70% of the capacity of venues for such events.

Fifth: The Ministry of Education shall issue a statement regarding the specifics of school education for the second term of the academic year 2021-2022.

The Supreme Committee stresses the importance of the adherence of government and private entities to the requirement of vaccination as a condition for entry to all government units and private sector establishments including commercial complexes, restaurants, and other commercial activities, as well as the attendance of cultural and sports events and other public events.

The Supreme Committee urges all to fully adhere to precautionary measures such as wearing the masks in all closed places, maintaining social distances,  avoiding crowded places and gatherings of all types, and maintaining the cleaning of hands. The committee also urges all citizens aged twelve years and older to take the initiative to receive the booster third shot of the COVID-19 vaccine, as the percentage of those vaccinated in this age group remains low at 9% for Omanis compared to 25% for expatriates.

Royal Decree 7/2022 Ratifying the Agreement between the Government of the Sultanate of Oman and the Government of the Republic of Colombia on the Mutual Visa Exemption for Holders of Diplomatic, Special, Service, and Official Passports

after perusal of the Basic Statute of the State,

and the Agreement between the Government of the Sultanate of Oman and the Government of the Republic of Colombia on the Mutual Visa Exemption for Holders of Diplomatic, Special, Service, and Official Passports signed in the city of Muscat on 24 January 2022,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 5/2022 Reinstating Omani Nationality and Authorising the Duality of Omani Nationality and British Nationality

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Omani Nationality Law promulgated by Royal Decree 38/2014,

and in pursuance of public interest,

have decreed as follows

Article I

Omani nationality is hereby reinstated to:

1. Zahia bint Abdullah bin Saleh Al-Dhabbaria.

2. Zuha bint Abdullah bin Saleh Al-Dhabbaria.

3. Zahi bin Abdullah bin Saleh Al-Dhabbari.

They are also authorised to dually hold Omani and British nationalities.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Telecommunications Regulatory Authority: Decision 42/2022 regarding the Frequency Spectrum Monitoring Service for Space Services

Based on the Telecommunications Law promulgated by Royal Decree 30/2002,

the Executive Regulation of the Telecommunications Law issued by Decision 144/2008,

the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

In the application of the provisions of this decision, “service applicant” means the local or global entity wishing to obtain frequency spectrum monitoring services for space services, and “space services” means the activities provided by the Telecommunications Regulatory Authority in the fields of space, whether in monitoring the frequency spectrum or solving radio interferences and this applies to satellites whose coverage includes the location of the station and the space orbits within the arc of visibility (133 East – 16 West).

Article II

The fees for providing space services are hereby determined—based on the request of the service application—in accordance with the following options:

One: Providing the service for each working hour at the rate of 281.000 (two hundred and eighty-one) Rial Omani.

Second: Providing the service under a contract to be made between the Telecommunications Regulatory Authority and the service applicant, in accordance with the following schedule:

Article III

The service applicant shall pay a minimum of 20% of the fee at the time of contracting. The remaining amount shall be paid in instalments every 3 (three) months from the date of contracting. The total fee amount must be paid to the authority before the expiration of the contract period.

Article IV

The service applicant may request the deferment of up to 50% of the contracted hours for a period not exceeding 6 (six) months from the date of expiration of the contract, while explaining the reasons for the deferment, provided that the authority agrees to this.

Article V

The service applicant shall deposit the fee amount into the bank account of the authority within 30 (thirty) days from the date the authority issues the payment notice.

Article VI

The authority may allocate 10% (ten percent) of the fee revenue to the company promoting the space services if the contracting with the service applicant is based on the promotion of the company.

Article VII

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article VIII

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
