Royal Decree 101/2020 Issuing the Governorates and Municipal Affairs System

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 18/86 Issuing the Dhofar Municipality Regulation,

the Law Governing Sohar Municipality promulgated by Royal Decree 9/97,

the Law Governing Regional Municipalities promulgated by Royal Decree 96/2000,

Royal Decree 37/2003 Determining the Competences of the Office of the Minister of State and Governor of Dhofar and Adopting the Organisational Structure of the Office,

Royal Decree 55/2006 Determining the Competences of the Ministry of Regional Municipalities and Water Resources and Adopting Its Organisational Structure,

Royal Decree 91/2008 Determining the Competences of the Governorate of Muscat and Adopting Its Organisational Structure,

Royal Decree 114/2011 Adopting the Administrative Divisions of the Sultanate and Governing the Work of Governors,

the Muscat Municipality Law promulgated by Royal Decree 38/2015,

Royal Decree 67/2019 Creating the Position of Minister of State and Governor of Musandam,

the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 86/2020 Repealing Some Laws,

Royal Decree 88/2020 Merging the Ministry of Justice and the Ministry of Legal Affairs into One Ministry Named the Ministry of Justice and Legal Affairs, Determining Its Competences, and Adopting Its Organisational Structure,

and Royal Decree 92/2020 Amending the Name of the Ministry of Agriculture and Fisheries to the Ministry of Agriculture, Fisheries, and Water Resources, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

The attached system shall apply in regard to governorates and municipal affairs.

Article II

The Minister of Interior shall issue the necessary regulations and decisions for implementing the provisions of the attached system, and until they are issued, the regulations and decisions in force continue to operate to the degree that they do not contradict with its provisions.

Article III

Without prejudice to article V of this decree and the provisions of the aforementioned Royal Decree 92/2020 Amending the Name of the Ministry of Agriculture and Fisheries to the Ministry of Agriculture, Fisheries, and Water Resources, Determining Its Competences, and Adopting Its Organisational Structure, all allocations, assets, rights, obligations, and holdings of the Ministry of Regional Municipalities and Water Resources are hereby transferred to the Ministry of Interior, and its employees are hereby transferred to the Ministry of the Interior with their same financial grades.

All allocations, assets, rights, obligations, and holdings of Sohar Municipality are also hereby transferred to the Ministry of Interior, and its employees are hereby transferred to it with their same financial grades.

Article IV

The Ministry of Interior shall transfer allocations, assets, rights, obligations, and holdings that were transferred to it, and the employees that were transferred to it, by virtue of article III of this royal decree and the aforementioned Royal Decree Merging the Ministry of Justice and the Ministry of Legal Affairs into One Ministry Named the Ministry of Justice and Legal Affairs, Determining Its Competences, and Adopting Its Organisational Structure, to governorates subordinate to it in accordance with the rules issued by a decision of the Minister of Interior.

Article V

All allocations, assets, rights, obligations, and holdings relating to regional municipalities of the divisions of the Ministry of Regional Municipalities and Water Resources in the Governorate of Musandam are hereby transferred to the Governorate of Musandam, and the employees of those divisions are also hereby transferred to the Governorate of Musandam with their same financial grades.

Article VI

All allocations, assets, rights, obligations, and holdings of Muscat Municipality are hereby transferred to the Governorate of Muscat, and its employees are also transferred to the Governorate of Muscat with their same financial grades.

Article VII

The Ministry of Regional Municipalities and Water Resources is hereby abolished, and all that is contrary to this decree and the attached system or in conflict with their provisions are hereby repealed.

Article VIII

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 88/2020 Merging the Ministry of Justice and the Ministry of Legal Affairs into One Ministry Named the Ministry of Justice and Legal Affairs, Determining Its Competences, and Adopting Its Organisational Structure

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 2/94 Amending the Ministerial Composition,

Royal Decree 14/94 Determining the Competences of the Ministry of Legal Affairs,

Royal Decree 114/94 Adopting the Organisational Structure of the Ministry of Legal Affairs,

Royal Decree 47/2000 Determining the Competences of the Ministry of Justice and Adopting Its Organisational Structure,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The “Ministry of Justice” and the “Ministry of Legal Affairs” are hereby merged into one ministry named the “Ministry of Justice and Legal Affairs,” and its competences are hereby determined in accordance with the attached Annex 1.

Article II

The organisational structure of the Ministry of Justice and Legal Affairs is hereby adopted in accordance with the attached Annex 2.

Article III

All allocations, assets, rights, obligations, and holdings of the Ministry of Legal Affairs are hereby transferred to the Ministry of Justice and Legal Affairs, and its employees are hereby transferred to the Ministry of Justice and Legal Affairs with their same financial grades.

Technical members of the Ministry of Legal Affairs are hereby also transferred to it with their same financial grades and entitlements, as well as their employment status.

Article IV

Without prejudice to the provisions of article V of this decree, all allocations, assets, rights, obligations, and holdings of the Ministry of Justice are hereby transferred to the Ministry of Justice and Legal Affairs, and its employees are hereby transferred to: the Ministry of Justice and Legal Affairs—including employees of the divisions relating to expert undertakings before the courts and lawyers affairs—; the Ministry of Interior; the Ministry of Endowments and Religious Affairs; the Secretariat General of the Council of Administrative Affairs for the Judiciary; and the Governorates of Muscat, Dhofar, and Musandam with their same financial grades, in accordance with the rules determined by the Council of Ministers.

Article V

All competences, allocations, assets, rights, obligations, and holdings of the divisions relating to mediation and conciliation in the Ministry of Justice are hereby transferred to the Ministry of Interior and the Governorates of Muscat, Dhofar, and Musandam—as the case may be—, and the employees of these divisions are also hereby transferred to those bodies—each according to their competence—with their same financial grades. 

All competences, allocations, assets, rights, obligations, and holdings of the Directorate General for the Management and Investment of Orphans and Minors Funds in the Ministry of Justice are hereby transferred to the Ministry of Endowments and Religious Affairs, and its employees are hereby transferred to the Ministry of Endowments and Religious Affairs with their same financial grades.

All competences, allocations, assets, rights, obligations, and holdings of the divisions relating to the public notary in the Ministry of Justice are also hereby transferred to the Council of Administrative Affairs for the Judiciary, and the employees of these divisions are hereby transferred to the Secretariat General of the Council of Administrative Affairs for the Judiciary with their same financial grades.

Article VI

The phrases “Ministry of Justice”; “Ministry of Legal Affairs”; “Minister of Justice”; and “Minister of Legal Affairs” wherever they occur in laws and royal decrees relating to legal affairs, expert undertakings before the courts, and advocacy are hereby replaced with the phrases “Ministry of Justice and Legal Affairs” and “Minister of Justice and Legal Affairs.” 

The phrases “Ministry of Justice” and “Minister of Justice” wherever they occur in laws and royal decrees relating to mediation and conciliation are hereby replaced with the phrases “Ministry of Interior”; “Governorate of Muscat”; “Governorate of Dhofar”; “Musandam Governorate”; “Minister of Interior”; “Minister of State and Governor of Muscat”; “ Minister of State and Governor of Dhofar”; and “Minister of State and Governor of Musandam” as the case may be. 

The phrases “Ministry of Justice” and “Minister of Justice,” wherever they occur in laws and royal decrees relating to the public notary are also hereby replaced with the phrases “Council of Administrative Affairs for the Judiciary” and “Chairman of Council of Administrative Affairs for the Judiciary.”

Article VII

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VIII

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 109/2020 Abolishing the Public Authority for Craft Industries

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 24/2003 Establishing the Public Authority for Craft Industries,

Royal Decree 53/2003 Issuing the System of the Public Authority for Craft Industries and Adopting Its Organisational Structure,

Royal Decree 91/2020 Amending the Name of the Ministry of Heritage and Culture to the Ministry of Heritage and Tourism, Determining Its Competences, and Adopting Its Organisational Structure,

and Royal Decree 107/2020 Establishing the Small and Medium Enterprises Development Authority, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

All allocations, assets, rights, obligations, and holdings relating to heritage in the Public Authority for Craft Industries are hereby transferred to the Ministry of Heritage and Tourism.

All allocations, assets, rights, obligations, and holdings relating to development, training, and support of craftsmen in the Public Authority for Craft Industries are hereby transferred to the Small and Medium Enterprises Development Authority.

Article II

The employees concerned with heritage in the Public Authority for Craft Industries are hereby transferred to the Ministry of Heritage and Tourism, and the rest of its employees are hereby transferred to the Small and Medium Enterprises Development Authority, with their same financial grades, in accordance with the rules determined by the Council of Ministers.

Article III

The Public Authority for Craft Industries is hereby abolished, and all that is contrary to this decree or in conflict with its provisions is hereby repealed.

Article IV

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 82/2020 Issuing the Employment Security System (Repealed)

This item has been repealed by virtue of Royal Decree 52/2023.

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Social Insurance Law promulgated by Royal Decree 72/91,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Employment Security System shall apply.

Article II

The Chairman of the Board of Directors of the Public Authority for Social Insurance shall issue the necessary regulations and decisions for implementing the provisions of the attached system.

Article III

The provisions of the attached system are amended by a decision of the Chairman of the Board of Directors of the Public Authority for Social Insurance after the approval of the Council of Ministers.

Article IV

All that is contrary to this decree and the attached system, or in conflict with their provisions, is hereby repealed.

Article V

This decree shall be published in the Official Gazette, and comes into force on 1 November 2020, with the exception of the following:

- Article 8 of the attached system comes into force on 1 January 2021.

- Article 12 of the attached system comes into force after a year from the date of entry into force of this decree.

Royal Decree 84/2020 regarding the Secretariat General of the Tender Board (Repealed)

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Tender Law promulgated by Royal Decree 36/2008,

Royal Decree 116/2010 Adopting the Organisational Structure of the Tender Board and Its Secretariat General,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The Tender Board shall have a secretariat general that has legal personality and enjoys financial and administrative independence.

Article II

The Secretariat General of the Tender Board shall have a secretary general with the special grade appointed by royal decree.

Article III

The Secretary General of the Tender Board shall manage all the administrative and financial affairs of the Secretariat General, and shall represent it in its relations with others and before the courts. He shall have the authorities of the head of the unit stipulated in the laws and royal decrees applicable to the units of the administrative apparatus of the state.

Article IV

The competences of the Secretariat General of the Tender Board are hereby determined in accordance with the attached Annex 1.

Article V

The organisational structure of the Secretariat General of the Tender Board is hereby adopted in accordance with the attached Annex 2.

Article VI

The aforementioned Royal Decree 116/2010 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article VII

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 83/2020 Amending Some Provisions of the Tender Law

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Tender Law promulgated by Royal Decree 36/2008,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned Tender Law shall be implemented.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree must be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 85/2020 regarding the Public Authority for Civil Aviation

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 18/2008 Determining the Competences of the Ministry of Environment and Climate Affairs and Adopting Its Organisational Structure,

Royal Decree 33/2012 Establishing the Public Authority for Civil Aviation,

and Royal Decree 43/2013 Issuing the System of the Public Authority for Civil Aviation,

and in pursuance of public interest,

have decreed as follows

Article I

The name of the “Public Authority for Civil Aviation” is hereby amended to the “Civil Aviation Authority.”

Article II

The competences relating to climate affairs are hereby assigned to the Civil Aviation Authority from the Ministry of Environment and Climate Affairs as specified in the attached annex.

Article III

All allocations, assets, rights, obligations, and holdings relating to climate affairs in the Ministry of Environment and Climate Affairs are hereby transferred to the Civil Aviation Authority “the Directorate General of Meteorology.”

Article IV

The employees concerned with climate affairs of the Ministry of Environment and Climate Affairs are hereby transferred to the Civil Aviation Authority “the Directorate General of Meteorology” with their same financial grades, in accordance with the rules specified by the Council of Ministers.

Article V

The text of article 5 of the aforementioned System of the Civil Aviation Authority is hereby replaced with the following text:

“The administration of the authority and the management of its affairs shall be undertaken by a board of directors formed by a decision of the Council of Ministers, and the term of membership of the board shall be 3 (three) years renewable for a single similar term.”

Article VI

The text of article 5 of the aforementioned Royal Decree 33/2012 is hereby replaced with the following text:

“The Civil Aviation Authority shall have a president with the special grade appointed by royal decree.”

Article VII

The phrase “Ministry of Environment and Climate Affairs” wherever it occurs in the laws and royal decrees relating to climate affairs is hereby replaced with the phrase “Civil Aviation Authority.” The phrase “Minister of Environment and Climate Affairs” wherever it occurs in laws and royal decrees relating to climate affairs is hereby replaced with the phrases “Chairman of the Board of Directors of the Civil Aviation Authority” or “President of the Civil Aviation Authority” as the case may be. The phrases “Public Authority for Civil Aviation” and “Executive President of the Public Authority for Civil Aviation” wherever they occur in the laws and royal decrees are hereby replaced with the phrases “Civil Aviation Authority” and “President of the Civil Aviation Authority.”

Article VIII

Article IV of the aforementioned Royal Decree 33/2012 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article IX

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 76/2020 Establishing the University of Technology and Applied Sciences

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 6/2002 Determining the Competences of the Ministry of Higher Education and Adopting Its Organisational Structure,

Royal Decree 76/2004 Determining the Competences of the Ministry of Manpower and Adopting Its Organisational Structure,

Royal Decree 62/2007 Governing the Colleges of Applied Sciences,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

A government university named the “University of Technology and Applied Sciences” is hereby established. It shall have legal personality, shall enjoy financial and administrative independence, and its headquarters shall be in the Governorate of Muscat.

Article II

The University of Technology and Applied Sciences shall have a Vice-Chancellor with the special grade appointed by royal decree.

Article III

All competences, allocations, assets, rights, obligations, and holdings of Rustaq College of Education, Colleges of Applied Sciences, Directorate General of the Colleges of Applied Sciences in the Ministry of Higher Education, Higher College of Technology, Colleges of Technology, and Directorate General of Technical Education in the Ministry of Manpower are hereby transferred to the University of Technology and Applied Sciences.

Article IV

Teaching and academic members of Rustaq College of Education and Colleges of Applied Sciences in the Ministry of Higher Education and Higher College of Technology and Colleges of Technology in the Ministry of Manpower are hereby transferred to the University of Technology and Applied Sciences with their same employment status and financial entitlements, as well as all the employees of these colleges with their same financial grades.

The employees of the Directorate General of the Colleges of Applied Sciences in the Ministry of Higher Education and the Directorate General of Technical Education in the Ministry of Manpower are hereby transferred to the University of Technology and Applied Sciences with their same financial grades, in accordance with the rules specified by the Council of Ministers.

Article V

The University of Technology and Applied Sciences shall undertake the competences prescribed to the Ministry of Higher Education and the Ministry of Manpower set out in the royal decrees and systems related to the colleges stipulated in article III of this decree.

The Vice-Chancellor of the University of Technology and Applied Sciences shall also exercise the competences prescribed to the Minister of Higher Education and the Minister of Manpower set out in the royal decrees and systems referred to in this article.

Article VI

The system of the University of Technology and Applied Sciences shall be issued by a royal decree, and until it is issued, the royal decrees and systems related to the colleges stipulated in article III of this decree shall continue to operate to the degree that they do not contradict with its provisions.

Article VII

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VIII

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 81/2020 Appointing to Some Positions

Article I

Those named below are hereby appointed each to the position following their name:

 Dr Said bin Hamad Al-Rubai – Vice-Chancellor of the University of Technology and Applied Sciences with his same grade and financial entitlements.

Dr Abdullah bin Khamis bin Ali Ambusaidi – Undersecretary of the Ministry of Education for Education.

Majid bin Said bin Sulaiman Al-Bahri – Undersecretary of the Ministry of Education for Administrative and Financial Affairs.

Dr Mohammed bin Said bin Khalfan Al-Mamari – Undersecretary of the Ministry of Endowments and Religious Affairs.

Dr Fatma bint Mohammed bin Baqir Al-Ajmiya – Undersecretary of the Ministry of Health for Administrative, Financial, and Planning Affairs.

Article II
